County Clerk Courts Division

The County Clerk is the clerk for the County Court at Law #1, presiding Judge Suzanne Brooks, County Court at Law #2, presiding Judge Tim Wright, County Court at Law #3, presiding Judge Don Higginbotham, and County Court at Law #4, presiding Judge John McMaster. The County Clerk files criminal, civil and probate cases in the County Courts at Law and collects all judgments from these courts.

Criminal Case Management

County Courts occupy the middle level of hierarchy of the court structure. The clerk files Class A and B misdemeanor cases and continues process until the case is closed or appealed to a higher court. The County Clerk has the responsibility to collect fines and the court costs of people who have been ordered by the court to pay them.

Civil Case Management

Civil cases do not deal with criminal activities, but rather with disputes between parties. Cases may be filed in County Court when the matter in controversy exceeds $500 but is not more than $100,000.

Probate Case Management

Probate cases deal with protecting the wishes, rights, and obligations of persons regarding their property when these persons are unable to do so as a result of death or incapacitating illness, either physical or mental. The County Clerk is responsible for filing, recording, and maintaining probate records.
